Is there an inherent conflict in Secretary of State Elaine Marshall regulating lobbyists while running ads about “taking on” lobbyists?
And is it proper for Marshall to ask lobbyists she regulates to contribute to her campaign?
I’ve talked to several lobbyists who are outraged by what they see as a conflict, but are afraid to speak out.
Last week, the Marshall campaign sent out – in its daily news summary – a press release announcing that Marshall “has officially launched an investigation of whether Larry Jones, president of the High Rock Lake Association, lobbied illegally for Alcoa in the General Assembly….”
Just before the Senate primary, news broke that Marshall’s office had fined former lobbyist Don Beason $110,000 for alleged lobbying-law violations.
One person emailed me:
“The SoS has an investigative group (including a former SBI investigator), and the rules and paperwork associated with lobbying have become so confusing that everyone’s afraid that a technical paperwork violation will put them on the front page of the N&O as a common criminal.”
Two lobbyists told me Marshall asked them to contribute to her campaign. Another said he supports Cal Cunningham, but is afraid to give him money.
Cunningham hasn’t made an issue of this. But the Republicans will. Tom Fetzer and Richard Burr will use it to paint Democrats as the party of corruption, scandal and prison stripes.
This is the second time Marshall has been able to run for a Senate seat without giving up her day job. That’s convenient for her.
This time, if she wins the primary, she should consider stepping aside temporarily. That would eliminate the possibility that she’ll cross a legal or ethical line. Plus, she won’t be subject to charges that she’s campaigning on state time.

Gee whiz. Those lobbyists need not fear anything except the illegalities they embark on on their own - i.e. Beason. Why do they tattle to you Gary? This looks like the old boy establishment trying to put it to Elaine Marshall cause she is beating the DC/Raleigh insider candidate. She need to step aside - she should continue to do her day job like everyone else does and did in the past - Bev Perdue, Jim Hunt, etc etc Just can't stop the money bleed from DC that is Cal

Gary, this is hardly up to your normal standards. If I might respectfully suggest that you either pick journalism or campaign consulting. There is an inherent conflict in trying to do both. You shouldn't be publishing stories calling a candidate into disrepute on allegations of unethical conduct passed along from sources you refuse to identify. Who are the lobbyists she asked for campaign contributions? Was there a quid pro quo implied or directly stated? If not, then, sorry, but nothing prevents a candidate from asking a private citizen to contribute to her campaign. She doesn't play ball with the folks you run with. I understand how that must grate at them. But you can't be casting aspersions with the convenient excuse of the anonymous complaint.

Gary is first and foremost a businessman...second a political pundit. The National Party is putting a ton of money into the Cal campaign and those that put out negatives about Cal's opponent...Elaine...could see some real benefits in their personal coffers and their personal endeavors if, in fact, Cal wins. So goes it with our man Gary here. He's not stupid. He's not right in who he is trying to support in a clandestine way, but he is most certainly setting himself up to be "on-board" if Cal wins. Get the picture?

I get it and it stinks. The good ole washington and raleigh boys are working to get their boy in and it is not about any of us, it is about them. Elaine Marshall should keep her day job just like Beverly Perdue did when she ran for Governor. It appears that people are getting desperate for the young man/all american family/john edwards look a like to get to DC.
